CLS Reaches $568,000 Settlement for Underpaid Home Health Employees
On November 1, Judge Timothy R. Rice issued an order granting the final approval for the settlement agreement of $568,000 for a claim brought by Jenifer Santiago Rivera on behalf of 268 home health aides against their employer, Vital Support Home Health Care Agency, Inc. (VSHHA). The lawsuit claimed that employees worked overtime and were not fairly compensated by VSHHA.
Nonprofit Partner Community Legal Services (CLS) and Berger & Montague, P.C. helped Jenifer Santiago Rivera and the other employees reach the $568,000 settlement. The class members were able to receive close to 100% of their unpaid overtime as a result of the settlement. Thanks to CLS and Berger & Montague, P.C., Jenifer Santiago Rivera and 268 other home health employees are now able to continue their meaningful work with fair compensation.
